As of May, 25 2018, the General Data Protection Regulation (GDPR) is applicable to comply with the European Directive 2016/680. This regulation constitutes the greatest alteration in the Privacy and Personal Data Protection laws of the last 20 years, and consequently is a challenge for all companies and organizations.

At AJ Aguiar, Lda we maintain and prioritize a responsible policy regarding privacy and personal data protection, ensuring the overall commitment of all entities (singular, business, public or subcontractors) with whom we interact. We carefully respect the privacy of your data in our databases.

In this spirit, we have been developing a significant series of changes in the company that not only aim review some internal procedures but also define the communication policy and strategy with all entities involved with us, especially our clients, for which we work on a daily basis in order to effectively implement all the guidelines defined in the new GRDP.

Within the diverse published literature, we emphasize to our contacts the responsibility inherent to the treatment, consent, access, rectification, portability and elimination of the data of each individual person. The explicit and objective consent is a matter that is causing some entropies amongst the business environment, because, while on the one hand it assures respect for the personal data of each one in a positive way, on the other hand, to some extent, it might make unfeasible part of the communication between companies, in terms of Direct Marketing, that is operated through the massive sending of news, events and newsletters. This type of consent is mandatory for individuals and not so much for collective entities, common companies or limited partnerships. Nevertheless, we shall raise two important questions here: how many of those companies do not use personal data to facilitate communication between different entities? How many of these entrepreneurs do not use their personal email or cell phone number to communicate with other companies?

From our standpoint in relation with the new GDPR there are cases in which this consent is not necessary: ​​in case of the use of the data to effect a contract, the issuance of a document of sale, or when a previous communication specifically states the possibility of the personal data owner to freely oppose its use. We take this communication to emphasize that, despite all efforts to implement these new guidelines and following the legal interpretation of the terms, we will continue to freely send all the latest information and news about our company to all our contacts in non-evasive newsletters.

Under the terms of the Law, at any time, you may request the cancellation of the receipt of this type of communication as well as request any changes to the personal data previously provided or its elimination from our database, and so on. We work hard to make it feasible and enforce the compliance with the regulation, but above all we privilege the freedom of all, namely the freedom of non-evasive communication between companies that often depend on the pedagogical process of transforming information into useful knowledge for their business area.
